What this page is for
SignPad lets people send PDFs to each other for electronic signature. If you believe a document being sent or stored on SignPad infringes your copyright, defames you, contains your personal information without your consent, or is otherwise unlawful, this page tells you how to report it. We act quickly on valid reports under the Australian Copyright Act 1968 and the safe-harbour scheme in Part V Division 2AA of that Act.
What we can and can't do
SignPad is a tool used by senders to send documents to signers. We don't review what's in the documents you send, we don't even look at them under normal operation. We can:
- Block a specific document from being viewed or signed further;
- Suspend a sender's account if they upload infringing or unlawful material;
- Provide the sender's account-holder name and email to a person with a valid Australian court order; and
- Cooperate with Australian law enforcement on a valid request.
We can't remove a document from the recipient's email inbox or from copies the recipient has already downloaded. We can't change a signed PDF after the fact (the audit trail would detect it).
How to file a report
Email sign@signpad.com.au with the subject line "Content Takedown Report". Include the following in the body of your email:
- Your full name, postal address, email and phone number.
- Identification of the material that infringes or is unlawful. For documents on SignPad this is usually the SignPad audit page URL (
signpad.com.au/audit?token=...) or a screenshot of the signing email. Include enough detail that we can find it.
- Identification of the copyrighted work (or other right) that has been infringed. If it's copyright, identify the original work. If it's defamation, identify the words you say are defamatory. If it's privacy, identify the personal information that has been disclosed without consent.
- A statement of good faith belief that the use of the material is not authorised by the rights owner, its agent or the law.
- A statement that the information in your report is accurate and that, under penalty of perjury, you are the rights owner or authorised to act on the rights owner's behalf.
- Your signature, physical or electronic. (Yes, you can use SignPad to send us the takedown notice itself.)
What happens next
- We acknowledge your report within 2 business days.
- If the report is complete and looks valid on its face, we will block access to the document and notify the sender within 5 business days, providing them a copy of your report.
- The sender has 10 business days to file a counter-notice (see below). If they don't, the block becomes permanent.
- If they do file a counter-notice and you don't notify us that you've started a court proceeding within 10 business days of receiving the counter-notice, we may restore access to the document.
Counter-notice procedure
If you are a SignPad customer whose document was taken down and you believe the takedown was a mistake, email sign@signpad.com.au with "Counter-notice" in the subject line. Include:
- Your full name, address, email and phone number.
- Identification of the document that was blocked.
- A statement under penalty of perjury that you have a good-faith belief the document was blocked by mistake or misidentification, and that you authorise the rights owner to be contacted using the email address above.
- Your consent to the jurisdiction of an Australian court in the State or Territory in which you live, for the purpose of resolving the dispute.
- Your signature.
Repeat infringers
We may terminate the SignPad accounts of customers who are determined, in appropriate circumstances, to be repeat infringers. "Repeat infringer" generally means three valid takedown notices against the same customer within a rolling 12-month period.
False or bad-faith reports
Filing a knowingly false takedown report is a misrepresentation under section 116AH of the Copyright Act 1968. You may be liable for damages caused to the sender, recipient or to SignPad. Don't use this process to harass a competitor or settle an unrelated grievance.
