Terms of Service

Plain English. No surprises.

1. Who is on the hook

"SignPad" is a service operated by Brix Super Group Pty Ltd (ABN to follow). "You" is whoever uses the service.

2. Your account

You're responsible for keeping your password safe. We won't ask you for it. If you suspect someone else has access to your account, change your password and email us.

3. What we let you do

You can use SignPad to send documents for electronic signature, store the resulting signed PDFs and audit trails, and brand the signing experience with your logo.

5. Payment

Free plans are free. Paid plans are billed in advance, monthly or annually, in AUD. If your payment fails, we'll email you and pause sending until it's resolved.

Cancel any time. We don't pro-rate refunds for unused time on monthly plans. Annual plans get pro-rated refunds if you cancel within the first 30 days.

6. Legal effect of signatures

Electronic signatures collected through SignPad are legally binding in Australia under the Electronic Transactions Act 1999 (Cth) and equivalent State and Territory Acts. We rely on you to confirm the signer's identity through whatever means your industry requires. We do not provide identity verification beyond email and IP capture.

7. The audit trail

Every event is captured, hashed, and chained. We make best efforts to keep the audit log accurate and tamper-evident, but we don't warrant that any particular audit record will be accepted as evidence in a particular court — that's a matter for the court.

8. Uptime

We aim for 99.9% uptime on Business plans. We don't promise specific uptime on Free, Solo or Team plans, though in practice we've always been close. If we have a major outage, we'll post an update at sign@signpad.com.au.

9. Limitation of liability

To the extent permitted by law, our total liability to you for any claim relating to SignPad is capped at the amount you paid us in the 12 months preceding the claim. We are not liable for indirect or consequential loss.

Nothing in these terms excludes any rights you have under the Australian Consumer Law.

10. Termination

You can stop using SignPad at any time. We can suspend or terminate your account if you violate these terms, with notice unless your actions are causing immediate harm.

11. Changes

If we make a material change to these terms, we'll email every account holder at least 30 days before it takes effect.

12. Governing law

These terms are governed by the laws of New South Wales, Australia. Any dispute is to be resolved in the courts of New South Wales.
